You have to be 7th level (ECL 7) and be of evil alignment. Now a quick talk about thieves and being evil. This doesn't mean you are going to steal off each other, that would be frowned upon. Too many times have I seen a party go bad because of someone being an idiot and deciding they can steal everything. I will only allow it if it fits in with the story.
Now Evil... this doesn't mean you are stupid, psychopathic, or dribbling mad insane and want to wear a kids heart on your head as a hat. It means that you can be very conniving, you have subtlety, perhaps some warped morality - in other words enjoy the character, remember you are masters of deception, the shadows, members of the Shadow Thieves and worshippers of Mask. You have known each other for some time and have quite a lot in common.
