Eradication From Existence
Evocation
Level: Sor/Wiz 9
Components: V, S, M
Casting Time: 1 Action
Range:Touch
Area: 1 target
Duration: Instantaneous
Saving Throw: Will negates
Spell Resistance: Yes

The caster must touch the target for this spell to work, if caster misses target then the spell fails. On touching the target if they fail their save they cease to exist, and have no way to be resurrected at all, the other effect is they are erased from everyone's memories too as if they had truly never existed at all. The spell automatically does 1d4 constitution damage to the caster due to the stress of bending the laws of time to his/her will, if the damage is more than the his/her constitution stat then they too are erased.
Tearing someone out of the timestream and then sewing reality back together without them is an extremely dangerous, some would say, foolhardy magic. If the spell succeeds, he must make a Will save (DC = 5 + the CR of the being erased, this DC should be increased if the being effected many lives, i.e. was a King, great hero, or other such important person). The Caster gains a +1 competence bonus to this save for each full 5 ranks of Knowledge (Planes). If the caster fails this save they will have something terrible happen to them or what they have altered at the bequest of the DM.

Interesting spell, but if I may make some suggestions . . .

First, reduce the automatic Con damage to 1d4 "from the stress of trying to manipulate time in this way."

And add: "Tearing someone out of the timestream and then sewing reality back together without them is an extremely dangerous, some would say, foolhardy magic. If the spell succeeds, he must make a Will save (DC = 5 + the CR of the being erased, this DC should be increased if the being effected many lives, i.e. was a King, great hero, or other such important person). If they fail this save something bad, from the caster perspective, happens with the timestream, maybe the eliminating being is replaced by his twin brother, who is almost exactly the same except he hates the caster passionately, or the caster never obtained his staff of the magi in this temporal reality, and so on as chosen by the DM."
